Apple opening remarks vs Samsung “easier to copy than to innovate”

This morning Apple has made its opening statement in a landmark case vs Samsung which will result, more than likely, in the exchanging of billions of dollars in damages for patent infringement on the part of one or both of them in the mobile device realm. Apple’s opening remarks come with what we’ve seen several times before, including such remarks as, “we all know it’s easier to copy than to innovate,” from Apple lead attorney Harold McElhinny. Samsung’s opening statements will come later in the day while Apple has had the first hour and a half.

Apple’s set of statements came after a video which was put on display for the benefit of the jury. This video contained a relatively easy to follow explanation of what patents were and how the USA patent system works. Have a peek at what they saw in this, the same video, as hosted by YouTube:

The video comes from PublicResource.org and is designed to be shown to jurors in patent jury trials in general. McElhinny spoke starting on how the iPhone was born, noting specifically, according to Ina Fried at AllThingsD, that Apple took a risk creating the iPhone.

“They were literally betting their company.” – McElhinny

Facing off against then giants like Nokia and Motorola, and of course Samsung as well, Apple went all-in with the iPhone, taking out applications for 200 innovations related to the device alone. McElhinny promised to show never before shown confidential Samsung documents that show Samsung’s first reaction to the iPhone. With these documents, McElhinny says, they’ll prove that Samsung decided to copy the design rather than innovate as a reaction to it.

“To be blunt, the testimony is going to show you that Samsung has not been honest about this copying.” – McElhinny

Stay tuned as Apple continues to expand on how they’ll be pushing for Samsung to admit their wrongdoing as well as Samsung opening up with comments on how it wasn’t they who broke the sacred bond of innovation, but Apple. Gmail for iOS Gets Mercifully Smoother Scrolling and Handy Image Saves [Gmail]

Google has rolled out a minor update to Gmail for iOS. Version 1.3 includes faster scrolling and animation (thankfully) on the iPhone and iPod touch. Additionally, now you can save photo attachments to your library the same way you save images from Facebook on your phone, by simply touching and holding. Transformers: Fall of Cybertron demo released

Transformers Fall of CybertronRemember the epic-looking Transformers: Fall of Cybertron game that was announced not too long ago? Well, it looks like you’ll finally be able to get a taste of the game. It’s not due out at retail outlets until next month but starting today, gamers will be able to download the demo for their Xbox 360 or PlayStation 3 video game consoles. The Fall of Cybertron demo will feature two missions from the campaign, letting users play as Bumbleebee and Vortex.

In addition to the single player missions, multiplayer is included with Team Deathmatch and Domination modes. There will be four multiplayer classes to choose from – Infiltrator, Titan, Destroyer and Scientist. However, players can level up to customize the classes to their liking. The Transformers: Fall of Cybertron demo is available now for the Xbox 360 on Xbox LIVE now, while PlayStation 3 gamers will be able to download it later this afternoon.

LG Nitro HD Ice Cream Sandwich ROM leaked

It is speculated that the LG Nitro HD would be on the receiving end of the Android 4.0 Ice Cream Sandwich operating system update at the end of this month (which is today), which is a good thing of course, never mind the fact that it has not made its way to hit Android 4.1 Jelly Bean. Still, being one generation behind is better than two, and while we await an official roll out of the Ice Cream Sandwich operating system update for the LG Nitro HD, someone has already leaked the aforementioned ROM to the masses.

This leaked version of the Ice Cream Sandwich ROM claims to be the official final build of said update, so those who have the intestinal fortitude and lack of patience can give it a go before sharing your experience before and after Ice Cream Sandwich – if the update worked well in the first place, of course. If you do consider this path, then make sure that LG Windows Suite will get flashed on your device, and you need no reminder that anything that happens to your LG Nitro HD if you decide to go unofficial with the leaked ROM will not be liable for a warranty replacement.

FreedomPop’s $99 WiMax iPod touch case promises an iPhone without the bills (video)

FreedomPop’s free-“4G”-for-all plans are clearer now that it’s started taking pre-orders on its $99 iPod touch sleeve. The free data allocation has been halved to 500MB, with each additional gigabyte costing $10, with the company offering bulk discounts to heavy users. Marketing VP Tony Miller also told TechCrunch that the iPod sleeve wasn’t a high priority until public clamor forced a shift in its plans, but said that an Android-compliant version of its gear was “on the roadmap.” There’s video after the jump.

eSSage delivers a soothing massage sans masseuse

There is nothing quite like the feeling of relaxing all those tired muscles after a particularly long and hard day at work, and in the perfect world, it would be a slew of lovely ladies rubbing down the neighborhood don, while he smokes on a cigar in one hand (lighted using nothing but $100 bills, no less) and a bottle of champagne nearby to savor the day’s takings on the streets. Well, not everyone is able to live out such a life, but that does not mean you should deprive yourself of a massage, right?

Those who prefer their bodies to be massaged remotely can do so via the conceptual eSSage – where it is remotely controlled over an Android or iOS app, allowing your finger (or stylus if you use one) to “work” those nodes on the touchscreen display, letting the eSSage do the massaging work in the designated in response. Alternatively, how about letting someone else take up your touchscreen device and choose the spots to be massaged for you? The thing is, will it ever make the jump from concept to reality?

Apple vs Samsung jury could bury Samsung’s Android momentum

The Apple vs Samsung trial in San Jose has only started this week, but the implications for the Korean company could be huge if its Cupertino foes convince the jury to impose all of the sanctions demanded. Apple has already petitioned to have the case deemed “exceptional” and the $2.5bn potential damages tripled, but the iPad maker is also hoping to not only sweep existing Samsung hardware from the shelves, but wipe out any financial advantage it may have built up from sales so far.

In addition to that $7.5bn damages demand, then, Apple also wants to grab 100-percent of Samsung’s profits from devices that the court deems infringing its patents, CNN reports. That could mean all of the profit from the Galaxy S, the breakthrough Android smartphone that helped make Samsung’s name, not to mention its Galaxy Tab 10.1 and original Galaxy Tab.

That cash-snatch would be a one-time thing, too, if Apple has its way. As well as taking all the money based on Samsung’s existing sales, any infringing devices would also be barred from sale under a permanent injunction. Currently, the Galaxy Tab 10.1 is subject to a preliminary injunction, granted by Justice Lucy Koh who presides over the trial this week, while the Galaxy Nexus squeaked through a preliminary injunction of its own courtesy of a hasty appeals court win.

Unsurprisingly, Samsung isn’t impressed with the scale of Apple’s demands. Describing the Cupertino company’s design patents as “little more than a blank rectangle with rounded corners,” the company argued that “Apple’s overreaching claim for damages is a natural extension of its attempt to monopolize the marketplace” in its pre-trial submissions. Earlier this week, Samsung’s product chief struck out at Apple’s litigation, branding the company as “defying common sense.”

Nonetheless, while legal experts express doubt that Apple will achieve all of its target damages, even if it achieves only part of them then Samsung’s momentum in the Android market could be severely impacted. The company would have to ensure that its roadmap didn’t infringe on any of the upheld design patents, or face immediate injunctions, a time-consuming and likely expensive process. That would not be insurmountable, but it could put a serious kink on Samsung’s product plans for the next 12 months.

All Facebook users to receive timeline this fall

Bad news for those of you who have been keeping your “legacy” Facebook profiles, it looks like you won’t be able to keep it for long. According to a report by TechCrunch who were informed by Facebook, every profile on the social network will changed to Timeline whether they like it or not. Facebook plans to complete this rollout by fall, so for those of you who’ve been putting it off or have been holding out – you might as well make the change now.

Microsoft Outlook webmail service launched

Microsoft seems to be on a rebranding exercise here, calling their latest webmail service “Outlook“. I am quite sure that many people would have the proverbial question mark appear right at the top of their respective heads upon hearing about a Microsoft Outlook that is webmail based. Basically, if you have a Hotmail account, just use the same username and password, and you too, will be able to log into Outlook.com so that you can give this webmail service a whirl to see whether it has enough bells and whistles to be a keeper. Connectivity is the new buzzword for Outlook here, where it remains connected to Facebook, Twitter, LinkedIn, Google, and in the future, Skype, so that your email will be flooded – nay, strategically placed to receive relevant context and communications.

Not only that, the new Outlook will be integrated with free Office Web Apps such as Microsoft Word, PowerPoint, Excel and OneNote, being the nouveau Google Docs for you to make changes to your important work documents wherever you are, unless there is no data signal whatsoever, of course. Will this be the new Gmail? I don’t think so, but it should be able to gain significant mileage at first. [Press Release]
