Apple vs Samsung Jury foreman speaks with Bloomberg in video interview

This week the Jury Foreman behind the Apple vs Samsung court case that’s been taking place over the past few weeks has spoken in an interview to Bloomberg. This video interview has Jury Foreman Velvin Hogan speaking on the lawsuit itself, moments during the deliberation, some of the jury’s “a-ha moments”, and a bit more on the final verdict they ended up reaching. The video also includes Hogan speaking again on “more than just a slap on the wrist”, a punishment for Samsung when patent cases are otherwise only supposed to bring renumeration for the patent holder – in this case Apple.

Hogan spoke with Reuters earlier this month with similar words for the public. Saying that the jury essentially wanted to punish Samsung for the infringement of patents at hand – that said, he noted that the jury didn’t quite feel that Apple deserved everything they were asking for. The was a note in the instructions for the case that made it clear that any penalties the jury issued should not be a “punishment” but rather simply “compensation.” That note read as follows:

“The amount of those damages must be adequate to compensate the patent holder for the infringement. A damages award should put the patent holder in approximately the financial position it would have been in had the infringement not occurred, but in no event may the damages award be less than a reasonable royalty. You should keep in mind that the damages you award are meant to compensate the patent holder and not to punish an infringer”

This set of revelations should come gift-wrapped to Samsung as they set themselves up to access any and all available means for appeal in the coming weeks. Samsung’s current penalty is above $1.05 billion USD while their push to counter-sue against Apple ended up with not a dollar to its name. Images Of HTC Desire X (Proto) Leaked


One of the most-anticipated devices from HTC is the HTC Desire X. The device is expected to be unveiled during IFA 2012 in Berlin, Germany. A recent leak hinted at the specifications of the device which include a 4” Super LCD Display with WVGA resolution, a 5-megapixel camera and 1GHz dual core processor.

Other purposed specs of the device include 768MB RAM, 4GB ROM, 25 GB of Dropbox space for 2 years and Android Ice Cream Sandwich. Android Ice Cream Sandwich will be part of the device right out of the box and not as an update. It will also come equipped with HTC Image Sense chip and a microSD memory card slot. (more…)

Skyrim: Hearthfire DLC lets you build your dream home

Bethesda has announced new DLC for the incredibly popular Skyrim, but this DLC probably isn’t what you were thinking it would be. Dubbed Hearthfire, this latest DLC pack focuses less on the adventuring aspects of the game and encourages players to not only build their own home, but start a family and settle down. We saw features like this in the Skyrim Game Jam video Todd Howard showed during his keynote at DICE 2012, but few were thinking that home building and adoption would end up being the focus of actual DLC.


In Hearthfire, players gain the ability to purchase a plot of land and then use raw materials to begin building their dream home. Judging from the trailer below, there seems to be a number of options for home building, ranging from kitchens and bedrooms to enchanter’s towers and greenhouses. Interior workbenches can be used to fill these rooms with craftable items, and once you’ve finished your house, you can move your spouse in and begin adopting kids.

Bethesda says that you’ll also need to defend your home from monsters, which suggests that there may be some tower defense elements to be found in Hearthfire. Players have the option of hiring a steward to purchase building materials and furnish their homes for them. Stewards can also hook you up with some transportation options, and even bring in a bard to stay in your home and sing songs about how awesome you are.

Hearthfire will be launching for Xbox 360 on September 4 and will cost 400 MSP. We would typically assume that it’s coming to PC and PS3 a month later, but that didn’t happen with Dawnguard, which PS3 players still haven’t received yet. AMD FX4130 delivers 38GHz quadcore on a budget, Aseries chips get even cheaperIf you’re building a starter desktop to get ready for school, you’ll be glad to know that AMD is squeaking just a little more value for the dollar out of its processors. The new quad-core FX-4130 takes a 200MHz hop forward from its predecessor to a 3.8GHz base speed, and ramps up to 3.9GHz if it’s feeling frisky. While it’s thirstier than the earlier FX-4100 at 125W of maximum power draw, the unlocked chip’s $112 retail cost is a potential sweet spot for those tailoring a system to a strict price. Anyone willing to trade overclocking support for yet more of a savings will be glad to know that AMD has been slashing the prices of its Fusion-based A-Series chips at the same time: the across-the-board cuts bring even the 2.9GHz A8-3850 down to $91. No breaks exist here for the performance crowd, alas, but AMD’s new proposition might be just the excuse needed to build that budget Windows 8 PC.

Apple Genius Training student workbook “leaked”

This week someone at Gizmodo has gotten their hands on a workbook of training documents used by Apple to make sure their Genius Bar works for the customers that need it. While it might seem that any Apple document not meant to be seen by the public would be full of undeniably valuable or otherwise magical information, here the content is essentially bland. The majority of the manual, it would seem, is dedicated to making sure that each Genius makes the customers they work with happy – and satisfied enough to buy products in the future.

The manual brings on just as much psychological training as it does technical info, with the phrase “Everyone in the Apple Store is in the business of selling” right at the core. There’s a section by the name of “Selling Gadget Joy” which uses the letters A.P.P.L.E. to make the concept simple for whoever’s aiming to become Genius material. (A)pproach, (P)robe, (P)resent, (L)isten, (E)nd. That’s the Apple way for a Genius.

One of the main abilities that every Genius is taught – or that they need, rather – is the ability to empathize with whoever they’re conversing with. Apple makes it clear that a Genius should often be using the “Three Fs: Feel, Felt, and Found. This works especially well when the customer is mistaken or has bad information.” This “Fs” situation works best when a Genius (or any other Apple Store employee, for that matter,) is speaking with a customer about a product that they feel has a feature that’s out of place – or if a product is too expensive.

“Customer: This Mac is just too expensive.
Genius: I can see how you’d feel this way. I felt the price was a little high, but I found it’s a real value because of all the built-in software and capabilities.”

There are a list of words not to use in the manual which all lead the Genius to agreeing with and helping the customer. For example instead of saying “freeze” or “frozen” or “crash”, a Genius should try to use “unexpectedly quits”, “does not respond”, or “stops responding”. Another example is “bug” or “problem” – a Genius is taught to say “condition”, “issue”, or “situation” instead.

In the end, the most controversial part of the training was the supposed set of Apple employees (or former employees) who found the training itself to be robotic. See if a Genius tells you the same next time you’re getting help from them in an Apple Store – was your training intense? They may very well tell you that they certainly felt that it was just fabulous.

Video: Bar-Worker Falls Down Ten Foot Hole

Unattended and bare manholes on roadsides can be very dangerous if there are no warning signs accompanying them. Most of us don’t tend to look at our feet or at the ground all the time to be aware of a gaping hole if there is one on our way.

Apparently, a bar worker shown in the video below makes the same careless mistake, only to meet an unfortunate accident. The man is apparently trying to switch channels on the TV on the other side of the bar and in doing so, hastily walks towards it. Little does he know that there’s a 10-foot hole gaping a few feet from him. Once he reaches the hole, he falls right through it.
