The Battle Continues: Apple/Samsung Injunction Hearing Set For September 20

Oh, you thought this whole mess was over now that Samsung has to pony up $1.049 billion in damages to its bitter rival Apple? Not by a long shot. According to The Verge, Samsung and Apple attorneys have been talking with Judge Koh about a preliminary injunction hearing, and have apparently agreed to schedule it on September 20.

Now that Apple has a considerable jury verdict to back up its claims, you can expect the company to push Samsung hard to either license the infringed patents in question (meaning Samsung would have to pay out even more money on top of the damages it already owes) or bar the Korean electronics giant from peddling some of its questionable wares in the United States.

Apple’s clearly not shy when pushing for that latter option too — the company won a preliminary injunction against the sale of Samsung’s Galaxy Nexus earlier this year (ordered by the same judge, no less), a move Samsung quickly appealed.

This song and dance is already familiar to both parties, which hopefully means they’ll make judicious use of their time. According to Judge Koh, Apple will file its motion by August 29th, after which Samsung’s (undoubtedly bummed) legal team will have two weeks to cobble together its crucial response. From there, Apple has two days to whip up a response to the response. Just like in these proceedings, both Apple and Samsung are stuck with page limits for all their filings, so neither of them can afford to go off on tangents.

NEW YORK — Police say six people wounded in a shooting outside the Empire State Building have been treated at a hospital and released.

The New York Police Department says three other victims are being treated for non-life-threatening injuries. One of them is being treated for elevated blood pressure.

A laid-off clothing designer fatally shot a former colleague near the skyscraper Friday morning. He then was shot dead by police officers during a confrontation that wounded the nine bystanders, who suffered graze wounds or other minor injuries.

Well. The verdict for the tech industry patent trial of the week is in, and the jury agreed with Apple’s version of the events enough to award it a billion dollars and change in damages while awarding Samsung… nothing. Naturally, the two companies differ in their viewpoints on this ruling, with Apple celebrating a decision that supports its originality and innovation, and is “sending a loud and clear message that stealing isn’t right.” Samsung, on the other hand, claims it’s all about standing up for the consumer, who it believes will be the true victim here, forced to pay more for fewer choices and less innovation now that one company has “a monopoly over rectangles with rounded corners.”

Before we get to the inevitable appeals, Apple is seeking a preliminary injunction against Samsung’s infringing products and Judge Lucy Koh has set September 20th as a date for the hearing. Apple has until the 29th to file its motion, which Samsung will have 14 days to respond to, before Apple has two days to craft a response of its own. While we all take a breather before the lawyers get back at it, you’ll find the statements from both companies after the break.

Update: As expected, Samsung has indicated it will appeal the ruling. Wall Street Journal’s Evan Ramstad tweets that it plans to file post-verdict motions to overturn the decision and if those are unsuccessful, it will take its case to the Appeals Court.

ITC rules that Apple did not violate Motorola’s patent, remands case back to judge

About a week ago we reported that some of Apple’s products, namely the iPhone, iPad and Macs could be banned on the 24th of August as part of an ongoing legal dispute between Apple and Motorola. As it turns out, luck really seems to be on Apple’s side as not only did the jury rule in Apple’s favor in the Apple vs Samsung lawsuit, but it seems that a Commission review of the ITC case between Apple and Motorola has determined that the Cupertino company did not violate the patent in question and basically exonerated Apple.

While Apple fans and customers might breathe a sigh of relief, it seems that this is not over yet as the ITC has handed the case back to the judge who gave the initial ruling where he will be reviewing his initial stance on the matter. Basically what this means is that while Apple might have escaped the ban on the 24th of August, there is still a chance that they might have their products banned in the future, although with the judge having to revisit the case, the clock has been reset and another ruling would probably take place in 2013. In any case we’ll be keeping our eyes peeled, so check back with us in the future for more updates.

Additional Grand Theft Auto 5 screenshots released, looks nothing short of stunning

Earlier this week we brought you some screenshots of Rockstar’s upcoming Grand Theft Auto 5, and for those who loved what they saw, you’re in luck as Rockstar has decided to release more screenshots from the game. With the post titled “Business”, this gives us a glimpse at some of the different modes of transportation in the game, such as a truck, a police car, a plane, helicopters and even a high-end sports car. We have to say that these look pretty amazing and we can’t imagine what the game will be like once it has been released. Unfortunately a release date for Grand Theft Auto 5 has yet to be announced, but at least the game itself has been confirmed which should appease fans of the franchise.
