Kathleen Sebelius Admits ‘Mistake’ In Probe On Violation Of Hatch Act

WASHINGTON, Sept 13 (Reuters) – U.S. Health and Human Services Secretary Kathleen Sebelius admits she made a mistake during remarks in February that investigators say violated a federal law restricting the political activities of government employees.

Sebelius, who is spearheading the implementation of President Barack Obama’s healthcare reform law, warned at a meeting of the Human Rights Campaign that progress made on gay and lesbian rights under Obama could be “wiped out in a heartbeat” if the president was not reelected in November.

She also called for the election of a Democratic governor in North Carolina. Human Rights Campaign represents people who are gay, lesbian, bisexual or transgender.

“Secretary Sebelius violated the Hatch Act by making extemporaneous political remarks,” investigators with the U.S. Office of Special Counsel concluded in a report that referred the case to the president for “appropriate action.”

The findings are unlikely to lead to disciplinary action against Sebelius but could provide fodder for Republicans, who vehemently oppose the Democratic Party’s embrace of homosexual rights issues, including gay marriage. Obama’s Republican challenger, Mitt Romney, has vowed to overturn the president’s policies, including the health reform law known as “Obamacare.”

“The report correctly states that I have acknowledged that the statements that you have identified were a mistake,” Sebelius said in a Sept. 7 letter to the Office of Special Counsel, which investigates alleged violations of the Hatch Act.

The Hatch Act prohibits most federal employees from engaging in political activity while on duty. But those nominated by the president and confirmed by the Senate are allowed to do so in a personal capacity if taxpayers do not bear the costs.

Sebelius, a former Democratic governor of Kansas, was appointed by Obama, confirmed by the Senate and sworn into office in April 2009.

A White House official would not say whether the president would take action, but added that Sebelius had acted quickly to rectify the situation and had not been accused of such violations before.

According to investigators, the Department of Health and Human Services promptly reclassified the event as a political activity and reimbursed the U.S. Treasury for the expense.

A department official said the Democratic National Committee had paid a $2,500 reimbursement for the cost of the trip.

“This error was immediately acknowledged by the secretary, promptly corrected, and no taxpayer dollars were misused,” White House spokesman Eric Schultz said in a statement. (Reporting by David Morgan; Editing by Lisa Von Ahn)

The Worst Thing About the iPhone 5 Is Also the Most Brilliant [IPhone]

The iPhone 5 is many things. It’s a pinnacle of product design. It’s a mild annoyance for iOS app developers. It’s very probably the next phone you buy. And it’s also, by broad consensus of the people who follow these things, totally boring. More »

Remembering Attica Prison: The ‘Bloodiest One-Day Encounter Between Americans Since The Civil War’

Forty-one years ago, the nation’s deadliest prison uprising came to a violent end at Attica Correctional Facility in Western New York as 1,000 National Guardsmen, prison guards, and state and local police stormed the facility and launched a full-scale assault on the inmates.

When the smoke cleared, 39 men — 10 hostages and 29 inmates — were dead.

The deadly four-day riot began Sept. 9, 1971. Nearly half of Attica prison’s approximately 2,200 inmates rebelled and seized control of the prison. Some were angry over the death of an African American activist at another prison, while others revolted because they were unhappy with the brutal living conditions inside Attica.

HP Envy Spectre XT review: a sleek and speedy Ultrabook with a killer keyboard

HP Envy Spectre XT a 13inch Ultrabook

HP’s Envy 14 Spectre hit almost all the right notes when we reviewed it back in March, thanks to its high-res display, sleek metal-and-glass design and brisk performance, but a stiff trackpad and the steep $1,400 price were clear downsides. The new Envy Spectre XT, a 13.3-inch Ivy Bridge-powered Ultrabook, has a thinner, lighter profile than its big brother, and a lower $1,000 price tag to match. That’s still not chump change, though, so does the XT deserve a spot in the top tier of Intel-approved ultraportables? Join us past the break for the full breakdown.

Killzone HD has a date with PSN this October 23rd

Last week, the Killzone Trilogy box set was announced where it merges Killzone 2 and Killzone 3 with a high-definition PS3 remaster of the original Killzone, making it the ideal purchase for hardcore fans of the franchise. Well, we diverge a wee bit today by focusing on the Killzone HD that will be released on PSN later next month – October 23rd, to be exact, alongside what the revealed Trophy List brings along to the table. The thing is, how does a 2004 title, albeit remastered in High Definition glory, fare after nearly a decade? This is where the story segment of the game is hugely important to make sure that gamers will still be able to return to it after many years without having any complaints other than the graphics.

Killzone HD now boasts of 720p graphics at a steady 30fps, sporting MSAA filtering, sharper textures and higher quality sound effects as you can see above. As for the trophy list, we still want to be under Santa’s “Nice” list this year, so you can head on here for the full set while we avoid the role of being a spoiler.

Nintendo’s Wii U Hits U.S. Stores November 18, Starts At $299.99

black1

Nintendo will finally make its Wii U available to customers this November, after having previewed the next-gen console for over a year now, the company announced at a press event today. The Wii U will come in a $299.99 Basic version in white with 8GB of onboard storage, and a 32GB Deluxe model in black for $349.99. It’ll hit the U.S. on November 18 and Europe on November 30.

The console will ship with one of its signature GamePads, the touchscreen controller that looks and behaves a bit like a standalone mobile console or a tablet, and which gives gamers an added element of play, either via second-screen content or via the ability to play games on the handset instead of the TV.

Early response to the controller device has been lukewarm, with many criticizing its battery life (three to five hours) and how it can’t operate as a standalone device without the Wii U base, something Sony is capitalizing on by making the Vita a second-screen device for some PS3 games. Another concern was that originally, each console only supported one GamePad at a time; Nintendo, however, has since said that the Wii U will ship with support for two GamePads at once. Wii U owners can also connect up to four Wii Remotes at once, and your existing hardware for the original Wii will be compatible.

For Nintendo, this is a huge launch. The company ran into trouble early on with its last hardware release, the 3DS, which started slowly even though it gradually gained steam. But following the blockbuster success of the Wii and Nintendo DS, it was a considerable wake-up call. The gaming giant posted its first loss in three quarters in July, owing to a 3DS that still wasn’t generating income despite an uptick in sales. Some credit the rise of mobile gaming as one of the reasons behind Nintendo’s flagging fortunes.

Depending on how the Wii U fares, we could see drastic changes at the Japanese game company. Shareholders have pushed Nintendo to consider becoming a platform-agnostic game publisher in order to get out of the thin-margin hardware game and bring lucrative brands like Mario to iOS and Android devices. The Wii U could be Nintendo’s last big chance to prove that it can still move hard goods, not just beloved gaming icons.
