It’s Legal to Jailbreak an iPhone, But Not an iPad

Jailbreaking an iOS device has been in a murky grey area legally, but it just got a lot clearer: today, the US Copyright Office issued an exemption to the Digital Millenium Copyright Act that jailbreaking a device does not violate US copyright law. However, it’s not a blanket ruling, because tablets are, according to the US Copyright Office, “difficult to define.” The Electronic Frontier Foundation, along with a host of other electronic freedom organiziations, has been appealing to the Copyright Office to make exemptions to the DMCA legalizing the customization of a device you own. Apparently, the exception was granted to allow users to use a program that’s available on one platform, but not others. And the ruling doesn’t just apply to iPhones, but perhaps to rooting the Android platform as well. According to the document:

In order to ensure that the public will have the continued ability to engage in noninfringing uses of copyrighted works…. It provides that the prohibition shall not apply to persons who are users of a copyrighted work in a particular class of works if such persons are, or in the succeeding three-year period are likely to be, adversely affected by virtue of the prohibition in their ability to make noninfringing uses of such works.

While a end-user was likely to face legal action for jailbreaking an iPhone at home, the talented hackers who open up Apple’s closed gardens were always at risk. So this is a good thing! But it doesn’t make the landscape much clearer, because now there’s legal fragmentation for the iOS jailbreaks. Take a look at the whole legal document here.

Ricky Bobby’s tracksuit from the movie Talladega Nights: The Ballad of Ricky Bobby is up for auction via a movie memorabilia company called ScreenUsed. The suit is an actual Sparco racing suit worn by professional racers, or in this case, Will Ferrell, when he played NASCAR racer Ricky Bobby.

It includes the Puma shoes Ferrell wore in the film as well as the Wonder Bread hat. If a racing suits isn’t your thing, this company is also putting up a ton of other awesome and geeky movie props and memorabilia in an auction to be held on November 3, 2012, which also includes some fun screen-used Star Trek and Star Wars items.

Other items up for auction include Neo’s coat from The Matrix Revolutions, Jayne Cobb’s Vera machine gun from Firefly, and even the Superman bodysuit Christopher Reeve wore in Superman III. You can even pick the gold jumpsuit with cape that Mike Myers wore in Goldmember – complete with padded crotch. There is a lot of other stuff in the auction too. I can’t decide if I want Ricky Bobby’s diving suit or the endoskeleton chest from Terminator 2: Judgment Day the most.

Ricky Bobby’s outfit is expected to fetch between $4,000 and $6,000 (USD).


Netflix details Windows 8 app as rumored Microsoft buyout leads to stock jump

If you’re a Netflix user who happens to be upgrading to Windows 8 today, then you’ll be pleased to know that the video streaming service has gone into detail about its Windows 8 app. Now available on the Windows 8 Store, the Netflix app lets you browse and watch content without actually going to the Netflix site, and it’s been engineered to work with both touch controls and the more traditional mouse and keyboard. Netflix director of product innovation Michael Spiegelman and engineering manager Matthew Trunell have even put together a little video that walks users through all of the new features of Netflix on Windows 8.


The Netflix Windows 8 app isn’t all that different from Netflix on other platforms, but there are few cool features that are worthy of a mention. For instance, Netflix has introduced a new feature called “Semantic Zoom,” which allows users to pinch and zoom out on the Home screen to see a broad overview of their recommendations. You can use Windows 8′s search function to find TV shows and movies within the Netflix app, and Netflix has also included a drop down ribbon at the top of the screen that you can use to get back to the Home screen or browse through the top 10, new releases, and genres. Interestingly, Forbes is reporting that Netflix stock was trading up today after rumors of a potential Microsoft buyout hit the Internet. We’re not sure if Microsoft actually is planning to purchase Netflix, but the fact that Netflix CEO Reed Hastings recently stepped down from Microsoft’s board of directors has some people thinking that a deal is in the works. Whether or not that’s actually the case, Netflix’s stock is up this afternoon, ending the trading day up $8.07 and settling at $69.58.

That’s a pretty significant gain of 13.12%, so investors must be excited about something. It’s worth pointing out that in after hours trading, Netflix has lost a bit of what it gained during the day, dropping $0.78 or 1.12%, but even when you count that, Netflix still had a great day. The question now becomes – is Microsoft truly plotting a buyout, or is all that nothing more than speculation? Hopefully we’ll be finding out soon.

Xbox SmartGlass makes Android app debut on Windows 8 day

It’s time for the next generation for Microsoft in so many more ways than one, hitting right this moment on all cylinders with the first iteration of Xbox SmartGlass for Android. Of course this isn’t related directly to Windows 8, but the release day – today, of all days – has us rather certain it wasn’t a coincidence. Feel free to expect a continued barrage of news bits and releases from Microsoft as they keep their press boat afloat now that Windows 8 is rocking and rolling for real.

This app will allow you to connect to your Xbox with your Android device. This connection is made over wi-fi as you sit in the same room as your console on the same network. You’ve got all of your Microsoft account media ready to work with, including such easy-to-manage bits as purchased videos and game stats, and it all plays instantly on whatever giant display you’ve got your Xbox connected to. You can also connect with your avatar and update your social information from all angles, of course.

This app lets you play, pause, fast forward, rewind, and stop videos playing on your Xbox 360, allows you to search your full catalog of videos, music, and games, and brings on full stats and achievements listed between you and your friends. With this Android app you’ll also be able to bring up a full keyboard for use with Internet Explorer as it appears on your Xbox – lucky you! There you can browse the web at will, all from the comfort of your couch.

Your Xbox 360 will be able to be controlled by you via your Android device with swipes and taps galore, this giving you a whole new way to enjoy your whole media experience. You’ll need an Xbox membership to sign in, and your device must be working with Android 4.0 Ice Cream Sandwich or higher – with a display thats WVGA resolution or higher. Installing and using this app has been hit-or-miss for us thus far, with less than perfect results on the Galaxy Note II and Google Nexus 7, but a perfect experience on the Galaxy S III.

Xbox SmartGlass now available in Google Play, brings console integration to Android

Hot on the heels of the Dashboard update for the Xbox 360, Microsoft’s SmartGlass integration is now a reality for Android 4.0 users. The companion app branches out from the earlier My Xbox Live app for Android and allows direct control of some console features from Google-powered gear. While Windows Phone users will find the tightest integration of all, the Android port still lets users steer through the Dashboard, input text, browse the web (with zooming), search for local content, and control media playback. Players can still chat with their friends and modify their Xbox profile if they’re not planning to lurk around the system all day. The interface is strikingly similar to past releases (including Android) and still demands at least an 800 x 480 screen for admission — sorry, Wildfire S fans.
