President Donald Trump is threatening to break up the 9th Circuit Court of Appeals, which blocked his executive order banning travel from several nations with large Muslim populations and restricted the acceptance of refugees. 

Asked by the Washington Examiner if he had considered proposals to split the court, Trump replied: “Absolutely, I have.” 

“There are many people that want to break up the 9th Circuit. It’s outrageous,” Trump told the website. “Everybody immediately runs to the 9th Circuit. And we have a big country. We have lots of other locations. But they immediately run to the 9th Circuit. Because they know that’s like, semi-automatic.”

Trump claimed that those who oppose him are “shopping” for sympathetic judges by going to the 9th Circuit, where 18 of the 25 jurists were appointed by Democratic presidents.

“You see judge-shopping, or what’s gone on with these people, they immediately run to the 9th Circuit,” he said. “It’s got close to an 80 percent reversal period, and what’s going on in the 9th Circuit is a shame.”

Trump’s comments echoed a series of tweets he fired off on Wednesday:

There are some flaws in Trump’s logic.

The most recent ruling against Trump, in which Judge William Orrick issued an injunction blocking his executive order targeting so-called sanctuary cities, didn’t occur in the 9th Circuit. It was in the United States District Court in San Francisco, which is one level below. 

In addition, judge-shopping did not occur. The case was brought by the city and county of San Francisco and the nearby county of Santa Clara, which are within the district as well as within the jurisdiction of the 9th Circuit.

The statistic Trump cited about the court’s rulings being overturned 80 percent of the time was also misleading. 

According to the Washington Post, 80 percent of the 9th Circuit decisions taken up by the Supreme Court were reversed in 2015-2016. Yet only one-tenth of 1 percent of the 9th Circuit’s decisions were heard by the Supreme Court. In addition, other circuit courts had even higher reversal rates. 

Finally, Trump can’t break up a circuit court on his own. He needs the help of Congress. And while some Republicans have pushed the idea of splitting the circuit and creating a new court, Democrats in the Senate would almost certainly block the move.

Responding to Trump’s comment that he “absolutely” was looking at breaking up the court, Senate Minority Leader Chuck Schumer (D-N.Y.) responded with two words:

Trevor Noah Knows How To Make Confederate Memorial Day Less Racist

A small number of states in the south observed Confederate Memorial Day this week and Trevor Noah has a few questions for those who decided to celebrate.

“First of all, the Confederacy fought the Civil War to defend slavery. Why would you honor that?” the “Daily Show” host said Wednesday night. “Secondly, what are black people supposed to do on this holiday?”

Noah attempted to unpack the controversial holiday during Wednesday’s episode, but he couldn’t get past the racial undertones of the Confederacy. He even found a stunning similarity between all the people who spoke out against the holiday on local news channels. (Hint: they’re all black.)

Noah did try to cut some slack for those who genuinely believe that Confederate Memorial Day celebrates their ancestors’ history and somehow doesn’t honor white supremacy. But, as Noah pointed out, that’s a hard case to make when some confederate monuments literally have the words “white supremacy” engraved onto it.

Noah also addressed the threats that workers tasked with taking down these types of statues statues have received, showing just how serious some people are about defending the Confederacy.

“City officials are wearing full body armor because they’re afraid that radicals with extreme beliefs might kill them,” he explained. “I wish there was a word to describe those kinds of people.”

But the “Daily Show” host didn’t just bash the state holiday. Noah also offered some suggestions to make the Confederate Memorial Day ― and those racist monuments ― fair for everyone. 

“If it’s all part of your history, then maybe you should include all of the history,” Noah suggested. “If you want to have the monument, then you should have to have a slave next to it ― for context!”

Bill O’Reilly made a thinly veiled reference to the sexual harassment scandal that cost him his job at Fox News by comparing his situation to that of his father, who served in World War II

On his podcast Wednesday, O’Reilly read a message from a fan who complimented his book, “Killing the Rising Sun.”

“I really like the way you wrapped it up, Bill, the last bit about your father caught me off-guard, but it was a really nice twist,” O’Reilly quoted. 

He then talked about how his father was a naval officer en route to Japan “and would have been killed in the invasion had the atom bombs not been dropped.” 

O’Reilly said he wouldn’t be here if his father had been killed in the war. 

And a lot of people are trying to kill me right now, as you know,” O’Reilly said. “But we’re going to tough that one out.”

He then recommended his book as “a great Father’s Day/Mother’s Day gift.”

O’Reilly also said the next book in his “Killing” series will be released in September.
