In a completely expected move, Samsung today filed to appeal the preliminary Galaxy Nexus ban granted to Apple last week, moving to stay the injunction. Among other claims, Samsung is arguing that the ban is “inconsistent with the Federal Circuit’s directive that market share losses must be substantial,” and, as Foss Patents puts it, “attributable to the ‘infringing feature,’ not just the presence of the infringing product on the market.” This, of course, mirrors Samsung’s appeal for the Galaxy Tab 10.1, which also had its US sales halted last week. The Federal Circuit could very well decide to stay, putting the devices back on store shelves, but until then, we imagine Sammy will be looking longingly at Posner’s courtroom.

It hasn’t been Samsung’s best week. Just days after Judge Lucy Koh granted a preliminary ban on sales of the Galaxy Tab 10.1, she’s following it up with a similar granted request on the Galaxy Nexus. Judge Koh had already signaled that she thought Apple’s lawsuit over four patents might have merit, but it’s only now that she’s deciding the potential damage is worth halting sales of the phone until there’s a final trial verdict. Samsung will no doubt try to appeal the dispute, which centers on Android 4.0’s slide-to-unlock mechanism (among other elements), but there’s a lot more urgency here than with the outgoing Tab 10.1: the Galaxy Nexus is still a current-generation device, and just became Google’s Android 4.1 phone flagship. Samsung’s odds aren’t great given that Apple has already used one of the patents to give HTC grief with its imports.

Update: As patent lawsuit guru Florian Mueller found, the clincher for the ban was the patent on unified search that’s linked to Siri. Although Judge Koh is inclined to believe Apple’s view regarding all four patents, that search patent is the one whose violation would reportedly merit more than a slap on the wrist. She’s similarly convinced that Apple’s patents are legitimate and likely won’t be dismissed anytime soon.

It isn’t hard to get an Android 4.0 phone under $200 if you’re willing to sign your life away with a contract. Getting one that’s worthwhile at that same figure contract-free, however, requires some jumping through hoops. MediaTek must be an acrobat, as it just released the MT6577, a chip design for the most entry level of smartphones. The part’s frugal focus doesn’t keep it from stuffing in a dual-core, 1GHz ARM Cortex-A9 processor, a PowerVR SGX series 5 for graphics and an HSPA modem for 3G. Those specifications would only have been cutting-edge in 2011, but they’re very speedy for a starter device in 2012 — fast enough to drive Google’s OS on a 720p screen while supporting 1080p video. The MT6577 is a drop-in replacement for its MT6575 ancestor, and it’s accordingly going to be used very quickly by “leading global customers” this summer. Knowing MediaTek’s most recent clients, that could soon lead to a sea of very affordable phones from Gigabyte, ZTE and others that have no problems eating an Ice Cream Sandwich.

Those of us yearning to bring Huawei’s Ascend D Quad on summer vacation will have to file that dream away for next year. The company’s consumer division chief, Yu Chengdong, has pushed back the phone’s volume production from this month to August. Blame for the setback rests squarely on that custom-developed K3V2 processor — there have been “technical problems” getting it ready, if we go by Huawei’s less than precise explanation. The timing certainly isn’t what we’d call ideal: now that the Galaxy S III and One X are both common features of the smartphone landscape, the Ascend D Quad’s performance won’t be turning nearly as many heads when it arrives. We’ll have to make do with the solid Ascend P1 in the meantime.

There’s been demo units, FCC filings and the obligatory blurry photos, so it was only a matter of time before leaked press imagery completed our picture of a Galaxy Note for T-Mobile USA. As long as they’re not cosmetic makeovers by wishful T-Mobile fans, the CellPhoneSignal images portray… well, a Galaxy Note. No exotic colors, no obvious clues supporting talk that it ships with a preloaded Android 4.0 upgrade. Most of the hardware changes, then, should be all about adapting the HSPA+ 3G to support T-Mobile’s airwaves. Unconfirmed talk has the Galaxy Note reaching Magenta on July 11th; that’s nine months after the original version popped up, but we’re sure some will be thankful just to have more choices than AT&T for that phablet fix.
