Apple loses iPhone trademark case in Brazil

A court decision made earlier today has ruled that Apple does not have exclusive rights to the “iPhone” trademark in the country of Brazil. This decision was made by Brazilian regulators who have found that the company Gradiente Electronica‘s registering of the iPhone name in the year 2000 takes away Apple’s ability to have the name cornered. Registering the name iPhone seven years before the Apple, Gradiente has released a device called “iPhone Neo One” just this past December.

It’s understood that Apple will be attempting to get an appeal, this according to the Institute of Industrial Property speaking with the BBC. Oddly enough, it would appear that Apple does have exclusive rights to the iPhone brand on everything that isn’t a smartphone – cords, accessories, and everything in-between. Meanwhile Gradiente retains an option to sue Apple for exclusivity of the iPhone name on smartphones.

As long as Gradiente refrains from suing Apple, the iPhone (be it an iPhone 5, iPhone 4S, or otherwise), will continue to be allowed to be sold. The Gradiente smartphone iPhone Neo One continues to be sold throughout the country as a rather basic Android-based smartphone. Apple is currently arguing that they should be given exclusive rights to the iPhone name because Gradiente did not release a device with the name until December of 2012.

Barring appeal, it would appear that both companies will continue to sell their own devices with “iPhone” in the name with awkward keyword searches abound. It is quite likely, on the other hand, that Apple will earn appeal and the case will continue into the near future. Stay tuned for more Brazilian trademark battle action!

Toyota top in 2013 reliability but US marques show resurgence

Auto reliability is up 5-percent overall, J.D. Power has declared for 2013, with some surprises for US manufacturers including General Motors, though Toyota stands clear as the overall winner despite its accelerator hangover. The Japanese firm dominated in seven segments, across all three of its Lexus, Toyota, and Scion brands, in the 2013 vehicle dependability study, based on 37,000 reports from 2010-year vehicles.

Singled out for praise were the Lexus ES 350, Lexus RX, Scion xB, Scion xD, Toyota Prius, Toyota Sienna, and the  Toyota RAV4, with the Lexus RX topping the chart for the fewest reported problems. Porsche, Lincoln, Toyota, and Mercedes Benz close out the top five marques.

However, it’s not just Lincoln flying the flag for American auto companies. General Motors snatched four awards in total, with the Buick Lucerne, Chevrolet Camaro, Chevrolet Tahoe, and the GMC Sierra HD all getting segment awards. Ford’s Ranger clinched an award in its segment, too, while Chrysler’s Ram saw the biggest year-on-year improvement in reliability.

If there were any doubts that reliability affects repurchasing behavior, J.D. Power’s findings dismiss them. 54-percent of owners stick with their current brand when buying their next vehicle, assuming they’ve had no problems with their existing vehicle. However, that brand loyalty drops to 41-percent after three or more issues; it’s even more of an issue among premium car brands, owner loyalty for which drops to 39-percent under the same circumstances.

That’s worth remembering for marques like the Lincoln Motor Company, which are attempting to refresh their image with a more luxury feel. However, it’s also a reality-check for the potential impact of high-profile safety recalls, as Toyota in particular has suffered from in recent months. In January, the company was forced to recall 1.1m cars worldwide, while the month before it paid out a $1.1bn settlement over acceleration lawsuits.

Despite Toyota cars bouncing back to the service centers like ping pong balls, that doesn’t appear to have negatively impacted its showing in the J.D. Power survey.

Apple loses iPhone trademark in Brazil, to a company that makes Android phones

Ouch. We had an inkling this might happen, but now it’s official: the Brazilian authorities have just ruled in favor of a small handset manufacturer called Gradiente Eletronica in its trademark tussle with Apple. Gradiente registered the name “iphone” in 2000, seven years before Cupertino set up shop in that country, so now it has the right to continue using the word on its devices — including the Android-powered iphone Neo One. The BBC reports that Apple is likely to appeal the decision, but if that fails there’s always, ahem, the other option.

Robot Penguin Spies On Penguin Colonies

You know what they say – when in Rome, do as the Romans do. Well, what happens when you want to get a closer look at how a waddle of penguins interact with one another? Dressing up in a penguin suit is a bird brained idea, so a BBC documentary team decided to release 50 spycams into such penguin colonies, where among them include cameras which functioned as eyes for robotic penguins, helping capture some really stunning close-up footage of the awkward looking flightless birds.

I do wonder, however, will some of the penguins actually attempt to mate with these robotic automatons? Nearly a year’s worth of footage capture through 50 different spycams will be used in the documentary, where some of them were disguised as chunks of snow or small boulders, although the most adorable ones would resemble those of robotic penguins. Of course, this leads one to think about how robotic insects (such as a robot bee) could eventually see action to further study the intricacies of a bee colony, no? One thing’s for sure though, such cameras were specially developed to be able to withstand extreme environments and temperatures without breaking down.

Amazon Cloud Player now available for Ford SYNC

Ever since Ford opened up its AppLink developer program, allowing anyone to submit apps for use in Ford SYNC-enabled vehicles, the company has seen an influx in compatible apps. One of the newest ones added is Amazon’s Cloud Player, which was announced during CES last month. The app will now let you control your music library using convenient voice controls while driving.

Users will be able to not only play songs and skip through them using voice controls, but they’ll also be able to navigate their entire library and even playlists. All of it is hands-free, meaning that once you pair your smartphone either through Bluetooth or USB, users won’t have to bother playing with their phones to get music to play, and Ford actually blocks you out of the app anyway so that you don’t get distracted while driving.

Currently, there’s only a handful of Ford vehicles that are SYNC Applink-equipped. These include the 2013 Ford Fiesta, Mustang, Focus, E-Series, C-MAX Hybrid, Expedition, Fusion, and the F-150 and Super Duty models. However, Ford will be making the feature more widely available in the future as an add-on option.

During CES 2013, Ford announced that over 1,000 app developers have signed up for the AppLink developer program, and even more have most likely signed up by now, so it looks like Ford is going all-in with its SYNC technology, and with more apps that come with SYNC enabled, the more that car buyers may be intrigued by Fords’ entertainment options.
