Why the FCC’s Got AT&T and Verizon Scared Shitless

Remember net neutrality? Over a year after Comcast’s torrent-killing ways turned it into a rallying cry for chest-slapping geek solidarity, it’s back. But this time, it’s got AT&T and Verizon scared shitless—and it might actually screw us over.

A quick refresher: Net neutrality is, simply, the principle that all data gets treated the same by an ISP or service, whether it’s incoming email or HD videos of dudes getting socked in the nuts by a 4-year-old on YouTube. A real-world example of very non-neutral behavior would be what got Comcast slapped by the FCC: specifically sabotaging torrents.

Theoretically, this could go beyond policing piracy, for instance if, say, Time Warner competitively blocked or slowed down Hulu, or if Verizon struck a deal with Google to give its data priority over traffic from Bing, so people using Google would get a way better experience than people using Bing. Streaming video is a not-so-coincidental theoretical example, since the explosion of video traffic is what the ISPs say is swallowing up all of the internet.

The end result of the threat of government-mandated net neutrality regulations for ISPs was a mixed “win” for consumers: AT&T, Comcast and Time Warner all responded with monthly data caps on their internet service in at least some of their markets. (Comcast limited it in all markets.)

As for the FCC telling ISPs to be more explicit about network management practices, Comcast started straight-up telling people heavy internet users would have their entire connections slowed down. While they suck for consumers, these are all “net neutral” practices, since no particular kind of data is discriminated against. The net neutrality debate fizzled down, though in some ways people were worse off than before.

With a new president, comes a new FCC chair, Julian Genachowski. Unlike his predecessor, who regularly reamed the cable industry but was a little too snuggly with the telecoms and against “hard and fast” net-neutrality rules, Genachowski is all about rules for everybody. Including the wireless carriers.

As you’re probably well aware, mobile broadband is treated way differently than the internet that’s piped into your house. It’s considered fragile. There’s far less of it to go around, with a less developed infrastructure and limited wireless spectrum to use. The rules for using it are tighter, like dating a nun. Restrictions abound, like no p2p. You don’t want the network to break, after all. That’s why, for instance, AT&T previously blocked Skype and SlingPlayer from running on 3G on the iPhone—and continues to block Sling—and why Apple rejects every torrent app that even tries to cross into the App Store.

In the past weeks, Genachowski has made it clear that he thinks that should change, that openness should “apply to the Internet however accessed.” He’s not saying they shouldn’t be able to manage the network to make sure it runs smoothly, to be clear. But if you were scratching your head about why AT&T conceded and opened their network up to VoIP on the iPhone, look no further than this nugget from Genachowski, from a speech he gave three weeks ago:

We’ve already seen some clear examples of deviations from the Internet’s historic openness. We have witnessed certain broadband providers unilaterally block access to VoIP applications (phone calls delivered over data networks)…”

AT&T very much does not want the government to tell it how to run its networks, particularly the mobile one. AT&T Mobility CEO Ralph de la Vega this week responded pretty clearly to the FCC’s plans:

“Before we begin ‘fixing’ what isn’t broken, we need to be thoughtful about the consequences. We believe the marketplace today is vibrant, and there is no need to burden the mobile Internet with onerous new regulations.”

So what’s going to happen?

Well, the FCC is clear about what it thinks. This week, at a wireless telecom conference, Genachowski reiterated that net neutrality should apply to mobile broadband too. If those regulations pass, we’ll likely see the same thing we saw with the landline providers: Caps (not just on 3G cards like there are now) and “transparent” network management. Goodbye unlimited mobile broadband like the iPhone has. You will pay for every ounce of data that you use. And if you’re “crowding” the network by downloading a bunch of stuff, you’re gonna get slowed down because that’s the easy “net neutral” way to keep users in check. How much better is that, really?

So iPhone users, enjoy your “unlimited” wireless connections now. Pay-per-byte data—for both wired and wireless broadband networks—may well be the road we’re going down. Verizon is the last major landline broadband provider who has held back from capping or throttling its services (looove my FiOS), but even its CTO says that eventually, “we are going to reach a point where we will sell packages of bytes.”

Hopefully those packages will come cheap.

FCC says there’s a ‘looming spectrum crisis’

“What happens when every wireless user has an iPhone, a Palm Pre, or a BlackBerry Tour?” Speaking at CTIA Wireless IT & Entertainment in San Diego today, FCC head Julius Genachowski has said that he wants to “close the spectrum gap” — the difference between the spectrum it’s making available for wireless data versus enormous usage projections (400 petabytes a month by 2013, he says) that’ll be brought about by smarter, easier-to-use devices and ubiquitous high-speed data through a handful of initiatives including the promotion of the smart use of existing spectrum through the use of femotcells, WiFi, and smart antennas, and — more importantly — reallocation of existing spectrum. Genachowski says there are “no easy pickings” for reallocation, but the Commission is aggressively pursuing additional airspace that can help keep 4G rollouts on track. He’s gone on to say that they’ll be adopting the widely-discussed “shot clock” policy for placement of new towers, giving locales a limited window to protest placement of cell sites that’ll help spread 4G services over wider footprints. The guy seems genuinely concerned about keeping 4G rollouts rolling, so let’s see just how far the guys in Washington are willing to go to do that.

Verizon: LTE rollout to be ‘as close to all-at-once as possible’

Historically, wireless rollouts have been miserably long, protracted affairs that take countless years to complete, but Verizon’s talking in some really aggressive terms as it moves to LTE. The company wants to be at or near 100 percent overlay with its legacy CDMA footprint by 2013, but a ton of major markets will be covered and commercially well before then — up to 30 in 2010. Speaking in an interview this week, Verizon Wireless CTO Tony Melone has reiterated that the company is still on track with its LTE deployment — music to our ears — and that they’re not looking to “tease” customers at length with trial deployments that would require moving cross-country to enjoy. They’re looking to establish a “significant footprint” out of the gate, which is allegedly made possibly in part by the LTE equipment’s ability to share some infrastructure (backhaul equipment, for instance) with the CDMA network it’ll be joining in cell sites around the country. Now, how about those USB LTE modems, Verizon?

Clearwire branding true 4G WiMAX rollouts ‘CLEAR,’ upgrading pre-WiMAX areas nationwide

Clearwire’s far too young of a company to be dealing with a mid-life crisis, but just a year or so after it really began rolling out its Clear WiMAX services in select portions of America, it appears that the outfit is changing names. Confusingly enough, the company (currently Clearwire) will be renaming itself as the service (currently Clear), leaving us to wonder what exactly CLEAR (the rebranded company) will call its WiMAX offerings. There’s no indication on the company’s website as to when it plans to make the rebranding official, but a customer in Charlotte, North Carolina has informed us that the change is already underway in the Queen City. According to him, his equipment was recently swapped out, with the new modem boasting a Motorola logo and a “CLEAR” logo instead of the “Clearwire” emblem as before. Interestingly, he also claims that his download speed received a (gratis) bump from 1.6Mbps to 5Mbps, which resulted in a “huge improvement in speed.” So, any other users out there getting their modems swapped out? Call us crazy, but we’re guessing it’s just a matter of time.

Update: Clearwire pinged us with a few clarifications here. Ready? Good. Clearwire, as a company, is not changing its name. So far as the SEC knows, the corporate entity will remain “Clearwire.” The new “CLEAR” branding is a push to market its true 4G WiMAX services (as opposed to “pre-WiMAX service”), which are rolling out to over 40 existing Clearwire markets around the country. Seems that explains the speed boost Mr. Rick experienced, huh?

T-Mobile negotiating to expand 4G service, Catherine Zeta-Jones going door-to-door

Word is that Deutsche Telekom (the parent company of T-Mobile) is now actively engaged in talks with Clearwire and MetroPCS to expand its 4G network. This isn’t terribly shocking to hear, considering that most other providers (including AT&T, Verizon and Sprint) are already either heavy into negotiations or in the process of upgrading their infrastructure. Though the company hasn’t yet said anything about planned expansions, word is its looking for the most “cost-effective” way to build nationwide networks capable of higher speeds.

Microsoft co-founder Paul Allen sells LTE spectrum to AT&T

Here’s one straight from the depths of left field. If you’ll recall, Microsoft’s co-founder Paul Allen was considering buying a bit of spectrum from the 700MHz auction after founding Vulcan Spectrum LLC. Evidently, the guy’s bid ended in a win, but he’s obviously not so keen on getting in on the flagging MVNO business. According to a document filed with the FCC, Allen has agreed to sell the licenses he owns — which cover sections of Oregon and Washington — to AT&T, though the carrier isn’t disclosing financial terms. According to AT&T spokesman Michael Coe, the company is making the purchase to “meet customer demand and to support its transition to LTE.” Unfortunately, Mr. Allen wasn’t available to say what he was planning to do with the proceeds, though we did hear that one Kayne West was available to reiterate his belief that LTE was the best of all time.

Clearwire says it’s not married to WiMAX for 4G, would be easy to switch

Save possibly for Sprint, no one’s pushing WiMAX harder in the US than Clearwire — but the commitment doesn’t run as deep as you might think. Investing billions in a 4G network that goes brashly against the popular LTE grain is a huge gamble since Clearwire and its partners won’t be able to throw as much weight around with manufacturers or achieve the same economies of scale that LTE carriers will, but these guys were smart: CEO Bill Morrow claims that the company has unprecedented flexibility built into its infrastructure, and he’s willing to switch gears if LTE or something else ends up burying WiMAX down the road. Boasting that “we’re the only carrier that can do this,” Morrow says that a move to LTE would be a simple software upgrade for much of its equipment, meaning Clearwire could almost literally change technologies overnight and with minimum expense — we’re sure it’d still put a strain on the bank, but it theoretically wouldn’t be as ambitious as changing from CDMA 1X to GSM, for example. Of course, the company’s still got all its eggs in one basket for the moment with a clear commitment to WiMAX — but from a shareholder perspective, it’s at least good to know that it’s easy to move the eggs.

Comcast could serve TV over WiMAX, inflate your bill even higher

Think you’re good at turning down the upsell? Try saying no to adding WiMAX to your home internet service for the low, low price of whatever Comcast wants to charge. Thanks to a multi-billion dollar tie-up with Clearwire, Comcast has been offering WiMAX-based internet services in a few markets, but now that On Demand Online is a go, it makes sense to think that the operator would use that as leverage to get people hooked. For those unaware, ODO enables Comcast pay-TV subscribers to watch a vast array of programming from any internet connection, which of course means that any ole 3G / 4G data connection would work just as well as Comcast’s own. Oh, and while mobile TV is pretty good — and we’re going to let Comcast finish — watching HDTV at home with a DVR is definitely the best scenario of all time.

Clearwire eyes global WiMAX roaming agreement, Kanye blurts out: ‘LTE is better!’

Pinky and the Brain were consulted, and you can rest assured they were both highly supportive of Clearwire’s latest initiative. Announced today in cooperation with Russia’s Yota and Japan’s UQ Communications, Clearwire has banged out a memorandum of understanding with the aforesaid WiMAX carriers that “identifies the objectives and activities each operator will perform towards the realization of establishing WiMAX roaming between the [two].” With translators in tow, the trio are hoping to define and institute the necessary processes that’ll ensure devices from each carrier works on the other’s network, and while American’s probably couldn’t care less about these two operators in particular, it’s the thought that counts. Just imagine — 4G global roaming at a decent price point. That, friends, is the future.

Sprint’s Dan Hesse talks Android, Pre, iPhone, 4G on Charlie Rose

Sprint CEO Dan Hesse recently sat down for an interview with the master of one-on-ones and black backdrops, Charlie Rose, and while much of the talk was spent traveling down memory lane and revisiting Hesse’s two-decade rise through the ranks at AT&T before fleeing in 2000, there were some great quotes that came out of it:

  • “We’re getting ready to launch a couple of new Android devices.” We know one’s the Hero, and the other — if we were the betting types — is the Samsung InstinctQ.
  • Rose: “The merger with Nextel was a bad idea?” Hesse: “In 20 / 20 hindsight, it was, yes… the premium that Sprint paid for Nextel was too much.” Sprint’s gone back and forth on the idea of spinning off Nextel over the past couple years, so it’s not a surprising thing for him to think — but to hear Sprint’s CEO actually say out loud that he thinks a very active part of its network shouldn’t have become part of the company is a little bombastic.
  • “Our prepaid brand is Boost.” Nothing wild and crazy about that statement, though it does reaffirm that Virgin Mobile is destined for assimilation. The whole thing’s kinda funny considering that Boost dabbled in CDMA before reversing course, and once again, Sprint will be dealing with large installed bases of both iDEN and CDMA prepaid customers.
  • On touchscreen smartphones: “Those are the most expensive phones for us to sell, and those are the ones where we need to make sure that the customer stays with us [and] doesn’t churn, because we’re out a lot of money… those are expensive devices.” Theoretically, an aggressively-priced subsidized smartphone could still end up leaving a carrier in the red if you broke your contract early on and paid the ETF, but we doubt that’s a huge problem — especially for a CDMA carrier like Sprint. He goes on to say “I’m already looking at 4G versions of smartphones,” so that’s really encouraging to hear, particularly if you’re into WiMAX.
  • “Customers will pay premium for simplicity. Simplicity is everything… Digital One Rate which we launched back at AT&T, that was all about simplicity… people paid more. It wasn’t a price cut.” Translation: “Unlimited makes you feel like you’re getting a deal, but rest assured, we’re banking.”
  • In response to Rose asking how Sprint uses the Palm Pre to take on Apple and RIM: “It was really kind of Palm’s decision to take on Apple. And Palm has had [a] long standing relationship with Sprint.” It’s interesting to hear Hesse seemingly back away from a fight with Apple and chalk up the situation to happenstance — RIM not as much, considering that Sprint carries a number of BlackBerrys in its lineup and will certainly continue to do so. Talking more about pitting the Pre against the iPhone, he goes on to say that Palm’s handset is “doing well. But you’ve got to almost put the iPhone, to be fair, in a separate category. The Apple brand and that device has done so well. It’s like comparing someone to Michael Jordan.” If that’s not a tactful acknowledgment that the iPhone is a bona fide wireless superstar, we don’t know what is. Hesse’s giving the iPhone the respect it’s rightfully earned — as any strategically-minded executive would.
  • “The biggest impediment to mobile growth is you got processors are getting a lot faster, screens are getting sharper, they use more and more power, and battery technology is not moving very fast… That’s the one breakthrough that the industry needs. It needs battery breakthroughs.” It’s good to hear that Hesse understands as well as everyone else that the wireless industry needs to be focused on making power draw a non-issue, but he sounds less convinced of the solution: “I don’t know. Solar we hope, and renewable energy sources.” When Sprint gets some cash socked away, it might consider throwing some R&D money at the problem — it’ll be first to market with something resembling a “national” 4G network, after all, and the situation’s only going to get worse.
