Typo Asks Judge To Dismiss BlackBerry LawsuitAs we’re sure many of you guys have heard by now, BlackBerry has filed a lawsuit against Ryan Seacrest’s company, Typo Products, whom they claim infringed upon the design of their trademark BlackBerry QWERTY keyboard. As you can see in the image above, we’re sure many will find it hard to deny that the keyboard’s design is reminiscent of the BlackBerry keyboard which has become something of a signature look for the Canadian company. However as we have heard in the past, just because it looks similar it does not mean that it is a slam dunk case as there are a lot of other factors to take into consideration.

However in the meantime, Typo Products has since asked the federal court judge presiding over the case to dismiss all the claims in BlackBerry’s complaint with prejudice, which essentially means that BlackBerry will not be able to claim copyright infringement again in the future over the same matter. One of the reasons that Typo claims is cause for dismissal is because one of the patents in BlackBerry’s claims isn’t valid, due to the design being available for sale since 1988 which was before BlackBerry’s own patent was approved. We’re not sure if the courts will be so ready to dismiss the case, but we’ll definitely be keeping our eyes and ears peeled for more information.

    Samsung Sues Dyson Over Vacuum Cleaner Design PatentOver the past couple of years, whenever Samsung is mentioned in a lawsuit, it is usually related to mobile phones and chances are Apple will be involved as well. However as a reminder, Samsung deals with a multitude of products, ranging from smartphones to tablets, to home electronics such as televisions, speakers, fridges, and even vacuum cleaners. That being said, it seems that Samsung will be suing UK-based company, Dyson, over a vacuum cleaner design patent in which Samsung claims that Dyson is trying to hamper “Samsung’s reputation through malicious suits.”

    According to the reports, Samsung is looking for Dyson to pay them as much as $9.4 million in damages, claiming that the company had infringed upon one of their patents related to vacuum cleaner design. Actually it was back in 2013 that Dyson themselves had filed a lawsuit against Samsung over the design of the Motion Sync vacuum cleaner made by Samsung, although Dyson has since withdrawn the case against Samsung several months later. We’re not sure if Samsung’s latest lawsuit against Dyson is retaliation for the initial lawsuit filed against them, but with the report that Samsung has calculated its brand value to be around 63 trillion won and could be looking at additional damages.

    Judge Dismisses Lawsuit Against Apple Over SiriWhen Siri was first introduced, Apple presented it in such a way that made the feature seem flawless and extremely responsive. In reality? Well back when Siri was first released with the iPhone 4S, it definitely did not perform as advertised. Many complaints found that Siri was slow, unresponsive, and failed to understand them as there were some accents that Siri found hard to listen to. Apple was hit with a lawsuit over false advertising which the company later claimed that Siri was still considered to be in beta, and now fast forward two years, a federal judge has decided to throw out the lawsuit against Apple, claiming that he did not find that Apple committed fraud.

    According to US District Judge, Claudia Wilken, she found that Apple’s marketing descriptions of Siri were not considered to be fraud, and that Apple’s claims of Siri being “the coolest feature”, a “breakthrough”, and “an intelligent personal assistant” were just “puffery” and were not grounds for a lawsuit. Based on this ruling, it would seem that future lawsuits against Apple over Siri will most likely face the same outcome as well, thanks to the ruling which has set a precedent for future cases. Customers who filed the lawsuit were not allowed to amend their complaint and their next course of action will be to appeal to a higher court.
