Ukraine Government Broadcasts Ominous Text Message To ProtestorsTaking part in a riot or protest can be dangerous as police might target you even if you were just standing there peacefully. However there is also the chance that no one will recognize you, given that some protests do consists of tens of thousands of participants, but over in the Ukraine, it looks like the government is trying to scare protestors into staying home. Apple’s Insistence On An Anti-Cloning Provision Could Be A Deal-Breaker For Samsung

Apples Insistence On An Anti Cloning Provision Could Be A Deal Breaker For SamsungEarlier this month we reported that Apple and Samsung would meet for settlement talks that would hopefully address their legal issues with one another next month. Apple and Samsung’s legal tussle has been going on for years now and like many others, think that it’s about time it comes to an end. After all if Apple can sign deals with Nokia and HTC, why not with Samsung, right? Well it seems that it might be because Samsung might take issue with one of Apple’s demands, which is an anti-cloning provision that has to be agreed upon by Samsung. This demand could be what FOSS Patents’ Florian Mueller calls a deal-breaker that would basically put the lawsuit back on track for a formal hearing.

According to Mueller, “But no matter how much Samsung may hate the notion of an anti-cloning provision (it’s definitely at odds with the strategy that enabled Samsung to become the global market leader in smartphones), it’s s safe assumption that a deal will only come into being if Samsung accepts this.” Apple’s attorneys confirm that anti-cloning provisions have been covered in previous talks, which “consistently included limits to both the scope of any license and a prohibition against cloning Apple products.” We’re not sure if the settlement talks will yield any positive results, but we guess we will just have to wait and see. What do you guys think? Will Samsung accept Apple’s demands for an anti-cloning provision?

Apple Facing Lawsuit Over User Information Collection In Massachusetts

Apple Facing Lawsuit Over User Information Collection In MassachusettsFor the most part when signing up for a new service or registering yourself with a company like Apple, you would naturally assume that they will not be taking your information and selling it to third parties. Of course this might differ from company to company depending on their terms and conditions (which many of us probably just gloss over). However it seems that over in Massachusetts, Apple is facing a new lawsuit from plaintiffs Adam Christensen, Jeffrey Scolnick, and William Farrell, all of whom are accusing Apple of forcing them to hand over their zip code when making credit card purchases, and then selling this information to third-party companies for profit.

It would seem that over in Massachusetts and under the state’s Unfair Trade Practices Act, it would be illegal for companies to compel customers for personally identifiable information beyond what is necessary in order to verify a credit card transaction. While Apple’s privacy policy does state that certain personal information is sold to “strategic partners”, we guess the beef here is that this information would not have been made available had Apple not forced them to provide personally identifiable information in the first place. The plaintiffs are looking to turn this into a class-action lawsuit and are seeking damages of $75 per violation that covers damages, litigation and attorney fees, and further relief. They are also petitioning that Apple should stop collecting zip codes in Massachusetts in compliance with state laws.
