Zediva ordered to permanently shut down operations, pay $1.8 million to MPAA

The last time we checked in with Zediva, the DVD streaming service was reeling from a court-ordered preliminary injunction that effectively brought its operations to a halt. At the time, the California-based company was still pinning its hopes on the promise of a forthcoming appeal, but those hopes were summarily quashed on Friday, when US District Judge John Walter rendered the injunction permanent. Zediva had previously exposed an apparent loophole in US copyright law, by allowing users to stream movies from physical DVDs located in Silicon Valley. This strategy allowed the firm to offer newly released movies well before other on-demand services, but according to Judge Walter, it was also illegal. Zediva will now have to cease all operations and pay $1.8 million in damages to the MPAA. The defendant has yet to comment on the decision, but MPAA Associate General Counsel Dan Robbins seemed understandably delighted: “This result sends a strong message to those who would exploit the studios’ works in violation of copyright law, on the Internet or elsewhere, and it is an important victory for the more than 2 million American men and women whose livelihoods depend on a thriving film and television industry.”

Amazon, Netflix ink licensing deals with ABC, add new content for you to munch on

It was a pretty busy day for the Disney-ABC Television Group yesterday, as the company announced a new licensing deal with Amazon, while renewing its pre-existing agreement with Netflix. The Amazon deal will allow Amazon Prime members to access all prior seasons of Grey’s Anatomy, every episode of Lost, and all previous seasons of The Secret Life of the American Teenager, among other series. Amazon expects to add a total of some 13,000 titles to Prime Instant Video by “early next year,” and just in time for the holiday season (as well as the release of the Kindle Fire). The renewal of Netflix’s deal, meanwhile, ensures that the company will continue to offer episodes of shows like Private Practice, Brothers and Sisters, and Ugly Betty, as well as new additions, including Switched at Birth, Kick Buttowski and Alias. Basically, though, it’s just more of the same. But at a time when Netflix is losing customers in the wake of its price hike and Qwikster debacle, maybe stability isn’t such a bad thing. Roku adds more games, cleans up the PQ on its latest streamers

Don’t think Roku is sitting back on its laurels after rolling out a slew of new hardware including the Roku 2 family and the new, low end Roku LT. As promised, it has issued a firmware update enabling new gaming options including Pac Man:CE, Galaga, and Angry Birds Seasons. Even if you’re committed to Roku’s hockey pucks as purely video streamers, there’s a new firmware update to correct, among other things, issues that caused a darker than normal image on some displays, WiFi performance, boot performance, readiness for HBO Go, and subtitles on Netflix. Warner pushes 28-day new release delay on Blockbuster, matches Redbox and Netflix

We suppose it’s good news / bad news for Blockbuster. The good news is that after going through bankruptcy and being sold, Warner Bros. has decided it’s healthy enough to take on the competition on even ground. The bad news, is that Warner has decided to give Blockbuster the same month long delay the studio loves so much before new movies can be rented out as its competitors, Redbox and Netflix. While Blockbuster has had delays at its kiosks already, being first to get new flicks in stores has been a part of its marketing for a while. The LA Times reports Blockbuster so far is turning to simply buying the copies it needs at retail to rent them out immediately, but we’ll see how long that lasts. If you enjoy your discs via kiosk or mail don’t think you’re out of the woods either, as the paper mentions Warner wants to delay new flicks to those outlets even longer when their deals are renegotiated.

Netflix US subscriber count drops by 800k in Q3, 21.45 million still streaming

After a tumultuous third quarter the numbers are finally in for Netflix, and as expected its price hike and Qwikster madness have cost it a few customers in the US. Currently the company is reporting a total of 23.79 million customers in the US, down from 24.59 million last quarter — fewer than even it projected a few weeks ago. According to the report, it lost more “long term” customers than expected, which it attributes, again, to its poor explanation of the reasoning behind the change. To address those decisions and its inability to reach a new deal with Starz it has a few more numbers to show, as apparently only 7 percent of new customers are opting for the $15.98 hybrid package, while Starz Play content currently accounts for about six percent of streaming hours. Other competitors are also mentioned — Amazon Prime Instant Video’s content library is referred to as “duplicative” and just a “small fraction” of what Netflix offers, as it counts on newly-signed exclusive deals to widen the gap.

Those deals mean new movies like Drive, Paranormal Activity 3, The Rum Diaries and The Immortals will show up on Netflix in the usual pay-TV window, on top of a library of catalog TV shows that pulls from all five broadcast networks and 95 percent of cable TV stations. Internationally, Netflix is up to one million customers in Canada where it plans to double quarterly content spending, while Latin American customers can look forward to iOS and Xbox support soon. While its UK launch is on for Q1, it expressed concern for competition from Sky Movies, BBC and Lovefilm, and it plans to hold off on further expansion after that. Netflix to expand to UK, Ireland in ‘early 2012,’ looks to challenge Lovefilm

Well it looks like Netflix’s rumored UK launch was a lot more than just a rumor. Today, the company announced that it will indeed expand to the UK and Ireland “in early 2012,” promising to offer unlimited streaming on PCs, tablets and mobile devices at a “low monthly subscription price.” The company didn’t say what that price would be, nor did it offer any details on available content or supported devices, though more details will be announced closer to its launch. We’re also expecting to hear more from Netflix during its Q3 earnings conference call later today, when we should find out about the impact of its recent price hike and Qwikster turnaround. Whether or not its foray into the UK can loosen Lovefilm‘s grip on the domestic market, however, remains to be seen. Full PR after the break.
